Real Estate

   We have been closing real estate purchases and refinances for over 50 years, and have completed thousands of real estate closings, with more closing each week.  We handle closings in North & South Carolina in Gaston, Mecklenburg, Lincoln, Catawba, Cleveland, York, and the surrounding counties- and even close beach properties in Horry or Georgetown, too!  We handle both residential and commercial sales and refinances-- ranging from vacant residential lots to multi-million dollar commercial or industrial complexes.  
     We prepare deeds, easements, rights of way, offers to purchase and contract, promissory notes, deeds of trust, and all other required documents for loan closings or cash closings.  We work with all lenders, including VA/FHA/USDA loans as well as conventional, and are also experienced with seller-financed closings and assisting investors with purchasing foreclosed or REO properties.  Our attorneys are approved by Chicago Title, Investors, Stewart, Fidelity, Commonwealth, and many other title insurance companies.  

      In addition, we are regularly hired by other attorneys to search titles for their upcoming closings.  We are known for our attention to detail and thoroughness in performing complex, full searches and frequently receive referrals in both North & South Carolina.

Estate Planning: Wills, Trusts, and Powers of Attorney

Proper estate planning is important to protect your assets and maximize your estate for the benefit of your family.  Did you know that if you do not have a Will, that the State decides what happens to your property when you pass away?  Often times this can lead to unintended consequences.  
      Our attorneys are experienced with preparing Wills, Trusts, Durable Business Powers of Attorney, Healthcare Powers of Attorney, Living Wills, and other documents necessary for estate planning.  Our strength is in listening to the needs of our clients and drafting appropriate documents tailored to their individual interests, needs, and goals.  Since we also practice probate estates, we know how to properly plan in order to minimize hassle, confusion, and expense for your family when the time comes.

Probate Estates

For many families, administering an estate when a loved one dies can be confusing and burdensome.  Our caring attorneys and paralegals are experienced with handling probate estates throughout North Carolina, including finding and safeguarding assets, preparing required filings, overseeing distributions, dealing with banks, and transferring titles with the DMV.  We work with executors and beneficiaries every step of the way to be sure that the estate is handled properly and in a timely manner.

Business Law

 The small business owner works hard to keep a business running.  Our attorneys can help with the legal aspects of starting up, running, selling, or winding up a business.  We are experienced with incorporating, getting the EIN, setting up the minute book, drafting minutes, resolutions, bylaws, or operating agreements, drafting commercial leases, closing stock purchase or asset purchase transactions, and drafting and filing security agreements.  Our attorneys can help you work with your CPA to decide what entity-- corporation, LLC, or partnership-- is right for your business.  While we do not offer tax advice, we would be happy to work with your CPA or accountant to make sure your incorporation or transactions are handled properly to meet the needs of your business.  We are also experienced with incorporating non-profit corporations and getting its 501(c)(3) determination letter.

Marie Michael Anders entered the practice of law in 2012. She was East Gaston's valedictorian in 2005, graduated from Wake Forest University cum laude with a Bachelor's Degree in English in 2009, and earned her law degree magna cum laude from Elon University School of Law in 2012, where she was a member of the law review. She is also licensed to practice law in South Carolina. Marie serves as the City Attorney for the City of Mount Holly. She is a member and Past President of the Mount Holly Rotary Club and previously served on the boards of the Mount Holly Farmer's Market, Mount Holly Historical Society, Mount Holly Rotary Club, Mount Holly Chamber, and the Mount Holly Community Development Foundation. She practices in North & South Carolina in the areas of real estate, elder law, wills & powers of attorney, probate estates, LLCs & corporations (including nonprofits & 501(c)(3)s), contracts, and municipal law. She is proud to be the next generation owner of her family's business which has been a fixture in the Mount Holly community for decades.

Kemp A. Michael has been serving Gaston County and the surrounding area as a North Carolina licensed attorney for fifty years. (But who's counting?) He graduated from Pfeiffer College in 1969 with a Bachelor's Degree in Economics and graduated from Wake Forest University School of Law in 1972. Kemp is active in community affairs, having served fourteen years as a member and two years as the Chairman of the Gaston County Board of Education. He was named Mount Holly Man of the Year in 2013 and was awarded The Order of the Long Leaf Pine in 2021. He is a Rotarian and a past president of the Mount Holly Rotary Club where he has been named a Paul Harris Fellow, and attends the First United Methodist Church of Mount Holly. He is the Assistant City Attorney for the City of Mount Holly, having previously held the position of City Attorney for 47 years. He is now "Of Counsel" to the firm and practices limited hours in the areas of real estate, elder law, wills & powers of attorney, probate estates, traffic, divorces, separation agreements, adoptions, personal injury/wrongful death, corporations & LLCs, contracts, and municipal law.

Brooke E. Shepherd Elting has been practicing law since 2007. She was East Gaston's valedictorian in 2000, earned her Bachelor's Degree from Wake Forest University in 2004, and earned her Juris Doctor from the University of North Carolina at Chapel Hill School of Law in 2007, where she was a member of the NC Journal of International Law and Commercial Regulation. Brooke is an active Rotarian, board member, and a past President of the Mount Holly Rotary Club where she has been named a Paul Harris Fellow, has served as a board member of the Mount Holly Community Development Foundation, and attends the First Baptist Church of Mount Holly. She is no longer practicing law full-time, and is currently focusing on her family. She keeps limited hours and practices in the areas of real estate, elder law, wills & powers of attorney, probate estates, adoptions, corporations & LLCs, and contracts.
